La materia estrattiva (miniere e cave), avendo un impatto rilevante sul territorio e sull’ambiente, è caratterizzata, sotto il profilo giuridico, da frequenti interventi legislativi, tesi a mitigare i riflessi negativi sul territorio stesso: all’evoluzione normativa fa seguito di riflesso l’elaborazione dottrinaria e giurisprudenziale. Inoltre la materia ha interferenze rilevanti con altre discipline, quali la tutela ambientale, l’urbanistica, ecc… Anche sotto questo profilo l’elaborazione giurisprudenziale acquista particolare peso e modificazione nel tempo. Annotated review of case law in mining subiect (2011-2013)
The extractive subject (mines and quarries), having a remarkable impact on the land and on the environment is characterized, under the legal aspect, by frequent legislative measures to mitigate the negative impact on the land: the law evolution follows as a consequence the development of doctrinal and jurisprudencial elaboration.
Besides, the subject has remarkable interferences with the environmental guardianship, the urbanism…
Also under this aspect the jurisprudential elaboration purchases particolar weight and modification in the time.
On this magazine with biennal cadence is published the review of jurispridence commented for allowing the connoisseurs of the subject and the operators toh ave a guide of reference.
